Your rights
If your personal data is processed (e.g., collected, recorded, stored, analyzed, modified, read, queried, disclosed, disseminated, compared, linked, restricted, deleted, destroyed), you are a data subject as defined by the GDPR. As a data subject, you have the following rights vis-à-vis the controller:
- Right of access (Article 15 GDPR)
- Right to rectification (Article 16 GDPR)
- Right to erasure (Article 17 GDPR)
- Right to restriction of processing (Article 18 GDPR)
- Right to data portability (Article 20 GDPR)
- Right to object (Article 21 GDPR)
The right to object
Under Article 21 GDPR, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Article 6(1)(e) or (f) GDPR. The right to object may be exercised if the processing
- is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, or
- is necessary to protect the legitimate interests of the controller or a third party, unless your interests or fundamental rights and freedoms that require the protection of personal data prevail (in particular, if you are a child), and
- the controllers cannot demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing does not serve the purpose of asserting, exercising, or defending legal claims.
The right to object may also be exercised if the processing is carried out for direct marketing purposes.
Withdrawal of consent
If your data is processed on the basis of your consent, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent prior to withdrawal.
Complaint
If you believe that the processing of your personal data violates data protection law or that your data protection rights have otherwise been infringed, please contact us. This will allow us to address your concerns. You also have the right to file a complaint with the Independent State Center for Data Protection Schleswig-Holstein (Unabhängiges Landeszentrum für Datenschutz, ULD).
